7. Marine Electronics & Commercial Use Disclaimer

Marine electronics products are intended for use in marine environments and may be subject to harsh conditions including saltwater exposure, vibration, electrical interference, and power fluctuations.

Mystique Marine (Pty) Ltd shall not be liable for any loss of income, loss of charter revenue, loss of hire, loss of use, vessel downtime, business interruption, or any indirect or consequential commercial loss, whether arising from:

Product failure, malfunction, or delayed availability

Installation, configuration, calibration, or commissioning

Warranty assessments, repairs, replacements, or lead times

Diagnostic processes or troubleshooting

This limitation applies regardless of whether the vessel is used for private, charter, commercial, or income-generating purposes, including but not limited to yacht charter operations, commercial vessels, or survey craft.

Under no circumstances shall Mystique Marine (Pty) Ltd be responsible for compensation relating to cancelled charters, lost bookings, refunds to third parties, operational penalties, or reputational damage.

Nothing in this clause limits or excludes liability where such limitation is not permitted under applicable South African law.

Professional installation is strongly recommended for all marine electronics.

8. Indemnity

You agree to indemnify and hold harmless Mystique Marine (Pty) Ltd, its directors, employees, agents, and suppliers from any claims, damages, losses, costs, or legal expenses arising from:

Your breach of these Terms and Conditions

Incorrect installation, misuse, or operation of products

9. Severability

If any provision of these Terms and Conditions is found to be unlawful, invalid, or unenforceable, such provision shall be severed, and the remaining provisions shall remain in full force and effect.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa, and you submit to the exclusive jurisdiction of the South African courts.

11. SMS Notifications

By placing an order with Mystique Marine (Pty) Ltd, you consent to us using your cellphone number solely for transactional communications, including delivery updates or order collection notifications.

We do not use SMS for marketing or promotional communications.
